Terms of Service

By accessing and using SHIFT ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any of these terms, you must not use the Platform.

SHIFT is an intelligent training platform that combines:

• Automatic training plan generation using artificial intelligence
• Professional oversight by certified coaches
• Wearable integrations (Strava, Oura, Withings, WHOOP, Ultrahuman)
• Performance analysis and advanced metrics

We offer two modes:

• B2B: For teams and organizations with dedicated coaches
• B2C: For self-managed individual athletes with AI assistance

3.1 Eligibility

You must be at least 13 years old to use SHIFT. Users under 16 require parental or legal guardian consent.

3.2 User Responsibilities

• Provide accurate and up-to-date information
• Keep your password confidential
• Notify us immediately of any unauthorized use of your account
• You are responsible for all activity under your account

4.1 Allowed:

• Use the Platform for your personal training
• Share your progress with your assigned coach
• Connect your authorized wearable devices
• Export your own training data

4.2 Prohibited:

• Reverse engineer or copy the Platform
• Access other users’ data without authorization
• Use bots, scrapers, or automated tools
• Upload malicious content (viruses, malware)
• Violate intellectual property rights
• Use the Platform for illegal activities
• Resell or commercialize access without authorization

AI-generated training plans are suggestions based on your data and goals. SHIFT does not guarantee specific results.

In B2B mode, AI plans are supervised and approved by human coaches before execution. In self-managed B2C mode, AI plans may be auto-approved if you enable that option.

SHIFT integrates with third-party services (Strava, Oura, Withings, WHOOP, Ultrahuman). When you connect these services:

• You agree to each platform’s terms of service
• You authorize SHIFT to access your data based on the permissions you grant
• SHIFT is not responsible for issues with third-party services
• You can disconnect integrations at any time from Settings

7.1 SHIFT’s Property

SHIFT and all content (code, design, algorithms, branding) are owned by SHIFT Training Platform and protected by intellectual property laws.

7.2 Your Data

You retain all rights to your personal and training data. By using SHIFT, you grant us a limited license to process this data to provide the service.

8.1 B2B

Teams and organizations are billed directly under the applicable commercial agreement.

8.2 B2C (Coming soon)

When available, individual subscriptions will be billed monthly. Specific payment terms will be provided at that time.

8.3 Refunds

We do not offer refunds except where required by applicable law or in exceptional cases at our discretion.

SHIFT is provided "as is" without warranties of any kind. We do not guarantee that:

• The service will be error-free or uninterrupted
• AI plans will produce specific results
• Third-party integrations will work without failures

To the maximum extent permitted by law, SHIFT will not be liable for indirect, incidental, special, or consequential damages, including loss of data, profits, or injuries arising from use of the Platform.

You agree to indemnify and hold SHIFT harmless from any claims arising from:

• Your violation of these Terms
• Your misuse of the Platform
• Injuries or damages resulting from following training plans
• Infringement of third-party rights

11.1 By You

You can close your account at any time from Settings > Account > Delete account.

11.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You fail to pay applicable fees
• You use the Platform abusively or fraudulently
• For legal or regulatory reasons

We may update these Terms from time to time. We will notify you of significant changes by email or via a notice in the Platform. Continued use after changes constitutes acceptance of the new terms.

These Terms are governed by the laws of Paraguay. Any disputes will be resolved in the competent courts of Asunción, Paraguay.

• Severability: If any provision is invalid, the remaining provisions remain in effect
• Entire agreement: These Terms constitute the entire agreement between you and SHIFT
• No waiver: Failure to enforce a right does not constitute a waiver
• Assignment: You may not transfer these Terms without our consent
